RE:
Advisory opinion request regarding the appointment of Mr. R.E. "Bob" Miller to the Louisiana Mineral Board.
Facts:
Mr. Miller was recently appointed by Governor Bobby Jindal to serve as a member of the Louisiana Mineral Board. Mr. Miller has asked if the Code would prevent his service on the Mineral Board as he is the sole owner of Major Equipment and Remediation Services, Inc.

Major Equipment contracts with British Petroleum, Stone and most of the large oil companies who operate in the State of Louisiana. Major Equipment rents large machinery and loans employees to these large corporations. Thee large oil companies to which Mr. Miller's company provides services for, bid on oil leases from the state. The Mineral Board oversees the process regarding the bidding on an administration of oil leases in the state.

Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant or any legal entity in which he owns in excess of 25% or exercise s control over, from receiving a thing of economic value for services rendered to the following persons: (1) those who have or are seeking to have a contractual, business or financial relationship with the public servants agency, (2) those who conduct operations or activities that are regulated by the public servants agency, and (3) those who have a substantial economic interest that could be affected by the performance or non-performance of the public job duties.

Recommendations:
Adopt the proposed advisory opinion.
