Advisory opinion request regarding whether Ken Singleton, a member of the St. Mary Parish Council, may sell land to the Plains Pipeline Company.
Facts:
Ken Singleton, a member of the St. Mary Parish Council, is considering selling a lot that he owns to Plains Pipeline Company. His lot is one of several tracts of land that will be traversed by a new pipeline project undertaken by Plains Pipeline Company. It is required by ordinance that a permit be obtained from the Parish Engineer for St. Mary Parish Government when crossing a road or highway with a pipeline. It is possible that Plains Pipeline Company may need to request a permit from the Parish Engineer. Permits are issued administratively and the St. Mary Parish Council has no oversight over the issuance of the permits. Mr. Singleton requests an opinion as to any potential conflicts regarding the proposed sale of his property to Plains Pipeline Company.
Law:
La. R.S. 42:1112A states that no public servant shall participate in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.

La. R.S. 42:1113A(1)(a) of the Code prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest from receiving any thing of economic value for services rendered to or for any person that has or is seeking to have a contractual, business or financial relationship with the public servant's agency.

Recommendations:
Allow the withdrawal of the request.
