Advisory Opinion Request regarding whether the members of the Louisiana Artificial Reef Development Council are required to file an annual personal financial disclosure statement pursuant to R.S. 42:1124.2.1 |

The Artificial Reef Development Council(Council) was created pursuant to La. R.S. 56:639.6, within the Department of Wildlife and Fisheries(Department). La.R.S. 56:639.8(A) created the Artificial Reef Development Fund(Fund). This Fund is to be administered by the Secretary of the Department. La..R.S. 56:639.8(D) provides that the Council shall review and comment on proposed expenditures from the Fund at the time of budget preparation by the Department but funds may only be withdrawn on warrant of the Secretary of the Department. The Council does not approve expenditures, the Council is merely advisory.

La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
