Advisory opinion regarding whether Ms. Carolyn Hill can be employed by Nonpublic Educational Services, Inc. (NESI) while serving as a member of the State Board of Elementary and Secondary Education (BESE).
Facts:
NESI is a nonprofit organization that provides educational services to school districts. Ms. Hill, who serves as the BESE representative for BESE District 8, has recently been offered employment as a social worker with NESI. She will be working in the Orleans Parish School System, which is outside her district.
BESE enacts policies and adopts regulations governing statewide operations of public and nonpublic secondary schools in Louisiana. However, the Orleans Parish School System is independent of BESE relative to its administrative decisions, such as determining and awarding contracts. BESE does not, nor does it anticipate ever having a contractual or business relationship with NESI. Further, based upon a follow up correspondence there does not appear to be any way in which the policies adopted by BESE could economically impact NESI.

Law:
Section 1111C(2)(d) prohibits a public servant from providing compensated services to a person who has a substantial economic interest in the performance or nonperformance of the public servant's job duties.

Recommendations:
Adopt proposed advisory opinion.
