Advisory opinion regarding when a former member of the Iberia Parish Airport Authority, Kenneth Squires, may seek employment with various companies that have relationships with the Airport Authority.
Facts:
Kenneth Squires states that he has resigned from the Airport Authority. He would like to go work as a paid consultant to recruit new aviation business on behalf of the Acadiana Regional Airport and the LeMaire Memorial Airport, both are owned by Iberia Parish.

He is also interested in working for the Iberia Parish Council. The Iberia Parish Council appointed Mr. Squires to the Airport Authority. The Airport Authority members are uncompensated volunteers.

He would like to also work for the Iberia Industrial Foundation. The Foundation is a non-profit chartered to find new industrial business in Iberia Parish and also to promote current business in the area. The Foundation receives $80,000 in subsidy from the Iberia Parish Council.

Mr. Squires would also like to work as an aviation business recruiter and offer new aviation business contracts to Iberia Parish directly.

Law:
Section 1121A(1) of the Code prohibits a former agency head, for a period of two years from the termination of his public service, from assisting a person, for compensation, in a transaction involving his former agency.

Section 1121A(2) of the Code prohibits a former member of a board or commission, for a period of two years following the termination of his public service on such board or commission, from being employed in any capacity by, or be appointed to, any position by that board or commission.

Section 1121B of the Code prohibits a public servant, for a period of two years following the termination of their employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity in which he was employed or for a period of two years following his termination, render a service which the former public servant rendered to the agency during the term of her public employment on a contractual basis regardless of the parties to the contract.

Recommendations:
Adopt the proposed advisory opinion.
