14. <br /> La. R.S. 42:1102 provides the following relevant definitions when analyzing the above <br /> Sections. <br /> (2)(a)(i) defines "agency" for public servants in the twenty principal departments <br /> of the executive branch of state government, to mean the office in which such <br /> public servant carries out his primary responsibilities; except that in the case of the <br /> secretary, deputy secretary, or undersecretary of any such department and officials <br /> carrying out the responsibilities of such department officers it shall mean the <br /> department 1n which he serves; and except that in the case of public servants <br /> who are members or employees of a board or commission or who provide <br /> staff assistance to a board or commission, it skull mean the board or <br /> commission. <br /> (12) defines "governmental entity"to mean the State of Louisiana.. <br /> (19) defines "public servant"to mean a public employee or elected official. <br /> (18)(a) defines a"public employee"to mean aliyone,whether compensated or not, <br /> who is: i) an administrative officer or official of a governmental entity who is not <br /> filling an elective office; (ii) Appointed by any elected official when acting in an <br /> official cap acity,and.the appointment is to a post or position wherein the appointee <br /> is to serve the governmental entity or an agency thereof, either as a member of ars <br /> agency, or as an employee thereof; (iii) Engaged in the performance of a <br /> governmental function; or (iv) Linder the supervision or authority of an elected <br /> official or another employee of the govermnental entity. <br /> 15. <br /> Based on the foregoing facts,Fabian Blache,1II, in his capacity as the.executive Secretary <br /> for the Louisiana State Board of Private Security Examiners, violated La. R.S. 42:1111(A)(1)(a.), <br /> by virtue of his receipt of overtime payments totaling$200,585,57 for 3,418.75 hours of overtime <br /> worked between January 7, 2 019, through July 4, 202 1. <br /> 16. <br /> Based on the foregoing facts,Fabian Blache,III, ire his capacity as the Executive Secretary <br /> for the Louisiana State Board of private Security Examiners, violated La.
