Agency Tracking No. 2024-28 8 <br /> Page 6of9 <br /> any officer, director, agent, or employee of such person, if such public servant knows <br /> or reasonably should know that such person: 1)Has or is seeping to obtain contractual <br /> or other business or financial relationships with the public servant's agency, or (2) Is <br /> 4. <br /> seeping, for compensation, to influence the passage or defeat of legislation by the <br /> public servant's agency. <br /> (e) La. R.S. 110 (2)(a)(vi) provides that the "agency" for a member of a governing <br /> authority of a political subdivision, it shall mean the govermuental entity. <br /> (f) La. R.S. 42#.1102(4) defines "assist" to mean to act in such a way as to help, advise, <br /> furnish information to, or aid a person with the intent to assist such person, <br /> (g) La. R.S.42-.,1102(9) defines "elected official"to mean any person holding an office in <br /> a govermnental entity which is filled by the vote of the appropriate electorate. <br /> (h) La. R.S.4 F 1102(11) defines "governing authority}to mean the body which exercises <br /> the legislative functions of a political subdivision. <br /> (i) La. R.S. 42:1102(12) defines "governinental entity" to mean the state or any political <br /> subdivision to which the elected official is erected. <br /> La. R.S. 42:1102(16) defines"person"to mean an individual or legal entity other than <br /> a govemmenta.l entity, or an agency thereof. <br /> (1c) La. R.S. 110 (1 ) defines ��govenunental entity" to mean the state or any political <br /> subdivision which employs the public employee. <br /> (1) La* R.S. 42:1102(22)(a) defines "thing of economic value" to mean money or any <br /> other thing having economic value, except promotional items having no substantial <br /> resale value} ph -naceutical smpples, medical devices, i-nedica.l foods, and infant <br /> formulas in compliance with the Food,Drug, and Cosmetic Act,21 U.S.C. 301 et seq., <br /> provided to a physician, health care professional, or appropriate public employee for <br /> the administration or dispensation to a patient at no cost to the patient; food, drink, or <br /> refteshments consumed by a public servant, including reasonable transportation and <br /> entertainment incidental thereto, while the personal guest of some person, and, with � <br /> reference to legislators and employees in the legislative branch of state govenirnent <br /> only, reasonable transportation when organized prirnarxly for educational or <br /> infonnational purposes, including food and drink incidental thereto, and includes but <br /> is not hinited to; (i) any loan, except a bora fide loan made by a duty licensed lending <br /> institution at the non-nal rate of interest, any property interest, interest in a contract, 1 <br /> merchandise, service, and any employment or other arrangement involving a right to 1 <br /> compensation; (ii') any option to obtain a thing of economic value, irrespective of the , <br /> conditions to the exercise of such. option (ill) any promise or undertaking for the <br /> present or future delivery or procurement of a thing of economic value. <br /> (m)La.
