La. R.S. 42:1141C(3)(a) and La. R.S. 42:1141.5; and East Baton Rouge Parish, the domicile of the <br />BOE and Ethics Adjudicatory Board,is the proper venue pursuant to La. R.S. 42:1141.3. <br />3. <br />In accordance with La. R.S. 42:1141C(3)(b)(iv), the BOE designatedTracy M. Barker, <br />Charles E. Reeves, Jr.,Kathryn Rich,Kelsey Simmons, and Jessica T. Meinersas theBOE’strial <br />attorneys in this matter,with Jessica T. Meiners serving as the Lead Trial Attorney. <br />III.ALLEGATIONS <br />4. <br />The Louisiana Liquefied Petroleum Gas Commission("the Commission"),within the <br />Louisiana Department of Public Safety and Corrections,was created in1950 pursuant to La. R.S. <br />40:1841and consists of five members:one ex officio memberand fourmembers appointed by the <br />governor.The Commission promulgates andenforces rules that ensure the safest possible <br />distribution, handling, and use of liquefiedpetroleum gas and anhydrous ammonia, necessary for <br />the protection, safety, and security ofthe public. <br />5. <br />Ricky L.Cleveland was firstappointed and commissionedas a member of the Commission <br />on September 2, 2022, by Governor Edwards.On February 26, 2025,hewas reappointed and <br />commissioned by Governor Landryand has continuously served as a member of the Commission <br />since his initial appointment in 2022. <br />6. <br />The Commission is the “agency”of Ricky L.Clevelandas defined by La.
