appointment is to a post or position wherein the appointee 'I's to serve the governmental entity or <br /> an agency thereof, either as a member of an agency, or as an employee thereof. (iii) engaged in the <br /> performance of a governmental function. (iv) under the supervision or authority of an elected <br /> official or another employee of the governmental entity. <br /> (e) Lot R.S.42:1102(19)defines "public servants' to mean a public employee or an elected <br /> official. <br /> (d) La. R.S. 42+1170A( )(a)(l)Commencing on January 1,2012, each public servant who <br /> was not required to complete education and training .pursuant to Paragraph 1) or (2) of this <br /> Subsection shall receive a minimum of one hour of education and training on the Code of <br /> governmental Ethics during each year of his public employment or terra of office, as the ease may <br /> be, <br /> (e) La.R.S.4 :1170E( ) If the board discovers that a public servant or lobbyist has failed <br /> to complete the training required by this Section,the board shall mall by certified mail a notice of <br /> noncompliance informing the person that the training required by this Section shall be completed <br /> within forty-five business days from the mailing of the notice of noncompliance. The notice of <br /> noncompliance shall include the deadline for completion of the training required by this Section. <br /> If the person completes the training prior to the deadline contained 1n the notice of noncompliance, <br /> no penalties shall be as se sscd against the person. <br /> (f)La. R.S. 42:1153B Upon a determination that any public employee or other person has <br /> violated any provision of any law within the jurisdiction of the Board of Ethics except violations <br /> of the Campaign Finance Disclosure.Act which shall be governed by Chapter I I of Title 18 of the <br /> Louisiana Revised Statutes of 1950,the Ethics Adjudicatory Board may remove, suspend,or'Order <br /> a reduction in pay, or demotion of the public employee or other person, or impose a fine of not <br /> more than ten thousand dollars, or both. <br /> V, <br /> PRAYER FOR RELIEF <br /> 1. <br /> Based on the foregoing alleged facts herein, Darin Collins, in his capacity as an appointed <br /> member of the Housing Authority of Jefferson Parish,violated La.R.S.42:1170 by virtue of failing <br /> to complete the mandated one hour ethics training course during 2020 and 202 1. <br /> Page 4 of 5 <br />
