appointment 'I's to a post or position wherein the appointee is to serve the governmental entity or <br /> an agency thereof, either as a member of an agency, or as an employee thereof. (iii) engaged 'in the <br /> performance of a governmental function, (iv) under the supervision or authority of an elected <br /> official or another employee of the governmental entity. <br /> (c) La. R.S.42;1102(19)defines "Public servant"to mean a public employee or an elected <br /> official. <br /> (d) La. R.S. 42*0 117 A(3)( )(i)Commencing on January 1, 2012, each public servant who <br /> was not required to complete education and training pursuant to Paragraph. (1) or (2) of this <br /> Subsection shall receive a minimum of one hour of education and training on the Code of <br /> Governmental Ethics during each year of his public employment or term of office, as the case may <br /> be. <br /> (e) La.R.S. 42:1170E(2) 1f the board discovers that a public servant or lobbyist has failed <br /> to eornplete the training required by this Section, the board shall mail by certified mail a notice of <br /> noncompliance informing the person that the training required by this Section. shall be completed <br /> within forty-five business days from the mailing of the notice of noncompliance. The notice of <br /> noncompliance shall include the deadline for completion of the training required by this Section. <br /> If the person completes the training prior to the deadline contained in the notice of noncompliance, <br /> no penalties shall be assessed against the person. <br /> (f)Iia. R.S. 42.1153E Upon a determination that any public employee or other person has <br /> violated any provision of any law within the jurisdiction of the Board of Ethics except violations <br /> of the Campaign Finance Disclosure Act which shall be governed by Chapter 11 of Title 18 of the <br /> Louisiana Revised Statutes of 1950,the Ethics Adjudicatory Board may remove,suspend, or order <br /> a reduction in pay, or demotion of the public employee or other person, or impose a fine of not <br /> more than ten thousand dollars, or both. <br /> v. <br /> PRAYER FoRE,L11 LiF <br /> L <br /> Based on the foregoing alleged facts herein, Dandy Boyd, in his capacity as an employee <br /> of the City of Monroe, violated La.
