3. <br /> In accordance with La. R.S. 42;1141 ( )(b)(iv), the BOE designated Tracy M. Barker, <br /> David Bordelon, Suzanne Q. looney, LaToya Jordan, Mallory Guillot, and Charles Reeves as <br /> the BOE's trial attorneys in this natter, with David M. Bordelon serving as the Lead Trial <br /> Attorney. <br /> ALLEGATIONS <br /> 4. <br /> Earl"Ben"Zalm assumed the Office of Mayor for the City of Kenner on January 13,2017. <br /> He was elected to a fall teen as Mayor in 2018, with his tern be ing on July 1, 2018, and <br /> ending on June 30,2022.�&.Zahn served as the elected Mayor for the City of Kenner at all times <br /> pertinent herein. <br /> 5. <br /> The City of Kelmer operates under a Home Rule Charter ("Charter"), of which, Article <br /> III, Section 3.09, states that the Mayor "shall execute all contracts, agreements instr rents of <br /> debt and the like for which the City is obligated, except such instruments as the Director of <br /> Finance may be authorized to execute." <br /> 6. <br /> The Cher provides that the City Attomey "shall supervise the conduct of the legal <br /> affairs of the City;"however, the City may enter contracts with outside counsel to, for example, <br /> assist in matters beyond the legal expertise o f the City Attorney's office, to avoid conflicts of <br /> interest or to ease staff workload.
