La. ILS. 42:1115A(1) provides with respect to gilts: <br /> A.No public servant shall solicit or accept, directly or indirectly, any thing of <br /> economic value as a gift or gratuity from any person or from any officer, <br /> director, agent, or employee of such person, if such public servant knows or <br /> reasonably should know that such person: <br /> (I) [las or is seeking to obtain contractual or other business or financial <br /> relationships with the public servant's agency. <br /> La. R.S. 42:1102(2)(a)(I) defines "agency"to mean: <br /> (2)(a)(I)adepartment,office,division,agency,commission,board,committee, <br /> or other organizational unit ofa governmental entity. <br /> La. R.S. 42:1102(2)(a)(vi)defines "agency" for members ofa city-parish council to <br /> mean: <br /> (2)(a)(vi) [t]or public servants of political subdivisions, it shall mean the <br /> agency in which the public servant serves, except that for members of any <br /> governing authority and for the elected or appointed chief executive of a <br /> governmental entity, it shall mean the governmental entity. Public servants of <br /> political subdivisions shall include,but shall not be limited to,elected officials <br /> and public employees of municipalities, parishes, and other political <br /> subdivisions. <br /> 22. <br /> La. R.S. 42:1113A provides with respect to prohibited transactions: <br /> A.no public servant,or a member of such a public servant's immediate family, <br /> or a legal entity in which he has a controlling interest shall bid on or enter into <br /> any contract, subcontract or other transaction that is under the supervision or <br /> jurisdiction of the agency of such public servant. <br /> Ethics Board Docket No.2016-527 Page 7 of 13 <br />
