BOARD OF ETHICS FOR ELECTED OFFICIALS <br /> DATED: namy )fl, 1(1g. <br /> FILED: m6\CA ) n ADVISORY OPINION NO. 82-02 D <br /> The Board has received a request for an opinion as <br /> to the propriety of the following: <br /> "A" is a member of the "'YZ" Parish Council. "A" is <br /> employed by the "ABC" Company. "A" has no financial <br /> interest in the "ABC" Company and all benefits and <br /> wages received by "A" are administered pursuant to a <br /> collective barganing contract. May "A" vote on (1) <br /> an application to rezone property owned by the "ABC" <br /> Company and (2) resolutions and ordinances to <br /> authorize the issuance of revenue bonds to finance <br /> the acquisition and construction of pollution <br /> control facilities and improvements to be leased to <br /> or sold to the "agency". <br /> 4110 The Board views as controlling the provisions of Sections <br /> 1111 C(2) (d) and 1112 B(3) of the Code which provide respectively as <br /> follows: <br /> "1111. Payments from nonpublic sources <br /> * * * * <br /> C. Payments for nonpublic service. <br /> * * * * <br /> (2) No public servant shall receive any <br /> thing of economic value for or in <br /> consideration of services rendered, or to <br /> be rendered, to or for any person during <br /> his public service unless such services <br /> are: <br /> * * * * * <br /> (d) neither performed for nor <br /> compensated by any person from whom <br /> 411 such public servant would be <br /> prohibited by R.S. 42:1115 from <br /> receiving a gift. <br /> 3� <br />
