• Docket No. 2001 -769 <br /> Page 3 of 5 <br /> amount of the violation, whichever is greater, except that the penalty for a knowing and <br /> willful violation shall be not more than $10,000 or 200% of the violation, whichever is <br /> greater. <br /> III. <br /> OPINION <br /> It is the opinion and conclusion of the Board that Judge Clark violated the restrictions <br /> on the use of campaign funds in the CFDA when she used campaign funds for personal use. <br /> The Board acknowledges that the funds were repaid to the campaign, but a violation occurred <br /> when the funds were initially loaned and used for inappropriate expenses. <br /> The Board concludes that the imposition of a civil penalty of $5,000 would <br /> adequately redress the above described violation of the CFDA. <br /> IV. <br /> DECREE AND ORDER <br /> For the foregoing reasons: <br /> IT IS ORDERED, ADJUDGED AND DECREED that the Board finds as a matter of <br /> fact and as a conclusion of law that The Honorable Janice Clark violated the restrictions on <br /> personal use of campaign funds contained in the CFDA. <br /> IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Judge Clark be <br /> ordered to pay to the State Treasurer of Louisiana the sum of $5,000 from personal funds as <br /> a penalty in this matter. <br /> 1 <br />
