R.S. 42:1121B(1) No former public employee shall, for a period of two years following the <br /> termination of his public employment,assist another person,for compensation,in a transaction,or <br /> in an appearance in connection with a transaction in which such former public employee <br /> participated at any time during his public employment and involving the governmental entity by <br /> which he was formerly employed, or for a period of two years following termination of his public <br /> employment, render, any service which such former public employee had rendered to the agency <br /> during the term of his public employment on a contractual basis, regardless of the parties to the <br /> contract, to, for, or on behalf of the agency with which he was formerly employed. <br /> La. R.S. 42:1102(2)(a) defines "agency" to mean a department, office, division, agency, <br /> commission, board, committee, or other organizational unit of a governmental entity. <br /> La. R.S. 42:1102(12) defines"governmental entity"to mean the state or any political subdivision <br /> which employs the public employee or employed the former public employee. <br /> ANALYSIS <br /> Your agency, pursuant to R.S. 42:1102(2)(a) is the LSUHSC Dept. of Academic Affairs. Your <br /> governmental entity, pursuant to R.S. 42:1102(12) is the State of Louisiana. <br /> Generally, as a former employee of the LSU Dept. of Academic Affairs, R.S. 42:1121B(l) will <br /> prohibit you, for a period of two years from the date of your retirement, from receiving <br /> compensation from Ochsner to participate in any transaction involving LSUHSC in which you <br /> participated while employed by LSUHSC.Additionally,you will be prohibited from rendering the <br /> same services to the LSUHSC Dept. of Academic Affairs that you rendered while employed by <br /> LSUHSC, on a contractual basis through Ochsner's partnership with LSUHSC. <br /> However,you would not be prohibited from being employed as the Manager of Strategic Academic <br /> Operations for Ochsner,provided that your new job duties with Ochsner would not involve any of <br /> the same transactions at LSUHSC in which you participated and that you would not be rendering <br /> the same services to the LSUHSC Dept. of Academic Affairs. If there are concerns as to any <br /> specific transactions or services to be performed, you should request an additional advisory <br /> opinion. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, R.S. 42:112113(1) will not prohibit you <br /> from being employed by Ochsner LSU Health as the Manager of Strategic Academic Operations, <br /> provided that your new job duties with Ochsner LSU Health would not be related to LSUHSC <br /> Dept. of Academic Affairs and would not involve the same services. <br /> Page 2 of 3 (BD 2022-380) <br />
