(d)Any person subject to the provisions of R.S. 27:63(C)(4),226(C)(4),or 261(D). <br /> ANALYSIS <br /> As a trade association, La. R.S. 1505.2L(3)(a) does not apply to SBA itself. As SBA itself does <br /> not have direct ownership in an entity to which La. R.S. 1505.2L(3)(a) applies (collectively, the <br /> "Restricted Entities"), SBA does not directly hold an interest in a Restricted Entity pursuant to La. <br /> R.S. 1505.21,(3)(b)(i). Because the Subject Member does not own at least 25%of SBA, SBA does <br /> not indirectly hold an interest in a Restricted Entity pursuant to La. R.S. 1505.21,(3)(b)(i). The <br /> provisions of La. R.S. 1505.21, would also not be applicable to SBA pursuant to La. R.S. <br /> 1505.21,(3)(b)(ii), La. R.S. 1505.2L(3)(c) or La. R.S. 1505.2L(3)(d). <br /> As there is no provision under which La. R.S. 1505.2L(3) applies to SBA, SBA would not be <br /> restricted by the provisions of La. R.S. 1505.2L(2). <br /> CONCLUSION <br /> Based on the facts presented, the Board concluded, and instructed me to inform you, that SBA is <br /> not prohibited by La. R.S. 1505.21, from making contributions to candidates and/or political <br /> committees in the State of Louisiana. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics. The Board issues no opinion as to past conduct or as to <br /> laws other than the Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure <br /> Act,the Lobbyist Disclosure Acts,and the conflict of interest provisions contained in the Louisiana <br /> Gaming Control Law.
