of Unaffiliated Vouchers would neither have or seek to have financial relationships with OAAS <br /> nor have operations or activities regulated by OAAS, The Forgotten War is permitted to receive <br /> compensation for recipients of Unaffiliated Vouchers. Further, as The Forgotten War neither has <br /> or seeks to have financial relationships with OAAS nor has operations or activities regulated by <br /> OAAS, you, personally, are permitted to receive compensation from The Forgotten War. <br /> With respect to the application for vouchers by The Forgotten War, La. R.S. 42:1113A prohibits <br /> you or a legal entity in which you have a controlling interest from bidding on or entering into any <br /> contract, subcontract or other transaction that is under the supervision or jurisdiction of your <br /> agency. As the Unaffiliated Vouchers would not be under the supervision or jurisdiction of OAAS <br /> or LDH, The Forgotten War may apply and receive Unaffiliated Vouchers. <br /> If you were to terminate your employment with OAAS, as you are not the agency head of OARS, <br /> the provisions of La. R.S. 42:1121B would prohibit you, for a period of 2 years from the <br /> termination of your employment, from receiving compensation to assist another person in a <br /> transaction, or in an appearance in connection with any matters you worked on while employed at <br /> LDH.Further,you would be prohibited from rendering any service to OAAS on a contractual basis <br /> if you had performed such services as an employee of LDH. Accordingly,for two years,you could <br /> not receive compensation from The Forgotten War to assist it in matters with OAAS if you had <br /> worked on such matters while employed at OAAS. <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that the Code would permit Forgotten War <br /> to receive compensation from recipients of Unaffiliated Vouchers and for you to receive <br /> compensation from Forgotten War. Additionally, each of you and Forgotten War may contract <br /> with agencies other than OAAS and LDH to obtain Unaffiliated Vouchers. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Louisiana Code of <br /> Governmental Ethics. The Board issues no opinion as to past conduct or as to laws other than the <br /> Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist <br /> Disclosure Acts, and the conflict of interest provisions contained in the Louisiana Gaming Control <br /> Law.
