Ethics Board Docket No. 2021-081 <br /> Page 6 of 9 <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE that Jennifer Davis's agency for purposes of the Ethics Code <br /> was St. James Parish. <br /> It is the opinion of the BOE that Jennifer Davis, in her capacity as the Personnel Manager <br /> for St. James Parish, and Jenn Davis LLC violated La. R.S. 42:1111B by virtue of her receipt of <br /> $3,846.90 from S&W Payroll Services LLC when Jennifer Davis directed the business of St.James <br /> Parish to S&W Payroll Services LL. <br /> It is the opinion of the BOE that Jennifer Davis, in her capacity as the Personnel Manager <br /> for St. James Parish,and Jenn Davis LLC violated La. R.S.42:1111C(2)(d)by virtue of her receipt <br /> of$3,846.90 for services rendered to S&W Payroll Services LLC when S&W Payroll Services <br /> LLC had a contractual,business, or other financial relationship with St. James Parish. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"), <br /> and the EAB found a violation of the Ethics Code, the EAB could impose a fine of up to $10,000 <br /> for each violation pursuant to La.R.S.42:1153.Additionally,the EAB could impose a civil penalty <br /> up to 1.5 times the amount of the illegal gain, pursuant to La. R.S. 42:1155. <br /> In this particular matter,the parties have agreed to resolve this matter amicably. Therefore, <br /> it is the conclusion of the BOE that the interests of the public and judicial efficiency would be <br /> served through the publication of this Consent Opinion with the imposition of a $1,250 civil <br /> penalty against Jennifer Davis and Jenn Davis LLC <br />
