Ethics Board Docket No. 2021-707 <br /> Page 7 of 11 <br /> of an agency head provided the immediate family member has been continuously employed for at <br /> least one year. <br /> Roxie Jackson is an immediate family member as defined by the Code of Amanda Guerrero <br /> by virtue of being her biological mother. Ms. Guerrero was employed as the Principal of the <br /> DeQuincy Primary School on March 7, 2021, when her mother became a substitute teacher with <br /> DeQuincy Primary School. As the Principal of DeQuincy Primary School, Ms. Guerrero was an <br /> agency head as defined by the Code. As such, Ms. Jackson could only be employed with the <br /> DeQuincy Primary School while her daughter served as the Principal if she had been continuously <br /> employed with the school for at least one year prior to Ms. Guerrero becoming the Principal on <br /> August 1, 2014. Therefore, Ms. Jackson's employment as a substitute teacher with DeQuincy <br /> Primary school was prohibited. <br /> In addition, prior to Ms. Jackson being hired as a substitute teacher, Ms. Guerrero <br /> participated in the hiring process by hiring her mother and submitting the paperwork requesting her <br /> as a substitute teacher. Ms.Guerrero was prohibited from participating in any transaction,the hiring <br /> process,in which her immediate family member had a substantial economic interest. Therefore,Ms. <br /> Guerrero's participation in the hiring process was prohibited by the Code. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics <br /> Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. In this <br /> particular situation,it is the conclusion of the Board that the interest of the public would be served <br /> by, and the parties have agreed to resolving this matter amicably through the publication of this <br />
