(18)(a) defines a"public employee" to mean anyone,whether compensated or not, who is: (i) an administrative officer or official of a governmental entity who is not filling an elective office; (ii) Appointed by any elected official when acting in an official capacity, and the appointment is to a post or position wherein the appointee is to serve the governmental entity or an agency thereof,either as a member of an agency, or as an employee thereof, (iii) Engaged in the performance of a governmental function; or (iv) Under the supervision or authority of an elected official or another employee of the governmental entity. (19) defines"public servant"to mean a public employee or elected official. V. OPINION: It is the opinion of the BOE that Anne"Beth"Jones violated La.R.S. 42:1117 by virtue of authorizing Billy Doiron to enter into transactions under the jurisdiction or supervision of the Live Oak High School and signing checks to Billy Doiron for his services in violation of La. R.S. 42:1113. In this particular matter,the parties have agreed to resolve this matter amicably. Therefore, it is the conclusion of the BOE that the interests of the public and judicial efficiency would be served through the publication of this Consent Opinion with the imposition of a civil penalty of $1,500.00 against Anne"Beth"Jones. VI. ORDER: For the foregoing reasons: IT IS ORDERED that Anne "Beth" Jones violated La. R.S. 42:1117 by virtue of authorizing Billy Doiron to enter into transactions under the jurisdiction or supervision of the Live Oak High School and signing checks to Billy Doiron for his services in violation of La. R.S. 42:1113.
