OPINION <br /> It is the opinion of the BOE that Rose Jackson was an appointed member of the District <br /> Board of Directors from December 14, 2016,until her resignation on August 10,2021. Therefore, <br /> Rose Jackson was prohibited by Section 1121(A)(2) from being employed by the District for a <br /> period of two years following her resignation as a member of the District Board of Directors. <br /> It is the opinion of the BOE that Rose Jackson, in her capacity as a former member of the <br /> District Board of Directors,violated La. R.S.42:1121(A)(2) by virtue of her employment with the <br /> District within two years of her resignation as a member of the District Board of Directors. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"), <br /> and the EAB found a violation of the Ethics Code, the EAB could impose a fine of up to $10,000 <br /> pursuant to La. R.S. 42:1153. Additionally, the EAB could impose a civil penalty up to 1.5 times <br /> the amount of the illegal gain,pursuant to La. R.S. 42:1155. <br /> In this particular matter,the parties have agreed to resolve this matter amicably. Therefore, <br /> it is the conclusion of the BOE that the interests of the public and judicial efficiency would be <br /> served through the publication of this Consent Opinion with the imposition of a$600 civil penalty <br /> against Rose Jackson. <br />
