Caption
The Code does not prohibit Daniel Casey Jr. from renewing his sales finance license with the Louisiana Motor Vehicle Commission while his sister, Amy Casey, serves as Executive Director. The Code does prohibit Amy Casey, as Executive Director, from participating in any transaction in which her brother has a substantial economic interest and requires her to submit a disqualification plan for approval by the Board of Ethics.

Your brother, Daniel Casey Jr., owns Casey Auto Sales LLC, <br /> which maintains a sales finance license with the LMVC. <br /> The sales finance license is renewed annually by submitting a standard renewal application to the <br /> LMVC. The requirements are set by statute. You stated that the LMVC staff follows a checklist of <br /> requirements, and if all are met, the license is set to be renewed without your input as Executive <br /> Director. The LMVC then ratifies the license renewals of all applicants without any further <br /> discretionary action. <br /> AGENCY <br /> La. R.S. 42:1102(19)defines"public servant" as a public employee or an elected official. La. R.S. <br /> 42:1102(18) defines "public employee" as anyone who is (i) an administrative officer or official <br /> of a governmental entity who is not filling an elective office, (iii) engaged in the performance of a <br /> governmental function, or (iv) under the supervision or authority of an elected official or another <br /> employee of the governmental entity. As an.employee of the LMVC, you are a public servant <br /> pursuant to La. R.S. 42:1102(18) and (19). <br /> La.
