an appointed member of the HAJP Board of Commissioners,Mr. Collins would be prohibited from <br /> debating and discussing any matters in which he would be required to recuse himself under La. <br /> R.S. 42:1112. <br /> With respect to HAJP's authority to force Mr. Collins to recuse himself,the Board does not provide <br /> an opinion, as such authority is not within the purview of the Louisiana Code of Ethics. <br /> CONCLUSION <br /> Based on the facts presented, the Board concluded, and instructed me to inform you, that, while <br /> he is the sole resident of Acre Road, Mr. Collins, in his capacity as member of the Board of <br /> Commissioners of HAJP, is prohibited from participating in any matters relating to Acre Road. <br /> Further, while he is President of MTO, Mr. Collins, in his capacity as member of the Board of <br /> Commissioners of HAJP, is prohibited from participating in any matters in which MTO has a <br /> substantial economic interest. Mr. Collins must recuse himself from participating in such matters. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics. The Board issues no opinion as to past conduct or as to <br /> laws other than the Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure <br /> Act,the Lobbyist Disclosure Acts,and the conflict of interest provisions contained in the Louisiana <br /> Gaming Control Law.
