(c)Is one in which the governmental entity has a direct interest. <br /> V. <br /> OPINION <br /> It is the opinion of the BOE that Robert Berry, while serving as an appointed board <br /> member of the Cypress-Black Bayou Recreation and Water Conservation District, violated La. <br /> R.S. 42:11138, which prohibited Mr. Berry from entering into transactions under the supervision <br /> or jurisdiction of the Cypress-Black Bayou Recreation and Water Conservation District. Mr. <br /> Berry was a public servant in his capacity as a board member of the Cypress-Black Bayou <br /> Recreation and Water Conservation District. Mr. Berry's agency for purposes of the Ethics Code <br /> was the Cypress-Black Bayou Recreation and Water Conservation District. <br /> Each paycheck and check for cell phone reimbursement received by Mr. Berry from the <br /> Cypress-Black Bayou Recreation and Water Conservation District while he served as a board <br /> member for his services as the Executive Director of the Cypress-Black Bayou Recreation and <br /> Water Conservation District has been alleged to be a prohibited transaction. Between 2016 through <br /> 2023, Mr. Berry has received paychecks totaling over 1 million dollars. Arguably, Mr. Berry <br /> may have been prohibited from receiving paychecks from the Cypress-Black Bayou Recreation <br /> and Water Conservation District for his employment as the Executive Director while serving as a <br /> board member of the Cypress- Black Bayou Recreation and Water Conservation District. <br /> It is the opinion of the BOE that Robert Berry, which he disputes based upon advice from <br /> the Water District's attorney and upon written decisions by the Bossier Parish District Court and <br /> Second Circuit Court of Appeal, that in his capacity as a board member of the Cypress-Black <br /> Bayou Recreation and Water Conservation District, he violated La. R.S. 42:1112A, which <br /> 7 <br />
