La. R.S. 42:1113A prohibits public servants from entering into transactions under the supervision <br /> or jurisdiction of their agency. As the Proposed Contract is between the Village and Mr. Fuller, <br /> this is not a contract with Mr. Fuller's agency. Further, simply because the Village receives its <br /> wat.-r from the Town,the Town does not have any supervision or jurisdiction over how the Village <br /> manages its water system. Accordingly, La. R.S. 42:1113A does not prohibit Mr. Fuller from <br /> entering into the Proposed Contract. <br /> La. R.S. 42:1111C(2)(d) prohibits a public servant, or an entity in which they exercise control, <br /> from receiving compensation from a person who has a financial relationship with their agency or <br /> conducts operations regulated by their agency. As La. R.S. 42:1102(16) defines a "person" as <br /> excluding governmental entities. Accordingly, because the compensation would be received by <br /> Mr. Fuller from the Village, and the Village is not a"person," Mr. Fuller would not be prohibited <br /> from receiving compensation under La. R.S. 42:1111C(2)(d). <br /> Finally, La. R.S. 42:1111C(l)(a) prohibits a public servant from receiving any thing of economic <br /> value for any service, the subject matter of which is devoted substantially to the responsibilities, <br /> programs, or operations of the agency of the public servant and in which the public servant has <br /> participated. The subject matter of the Proposed Contract is insufficiently related to the <br /> responsibilities or operations of the Town for this to represent a violation of La. R.S. <br /> 4-2:'L I 11 C(1)(a). <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code does not prohibit you, as a <br /> councilmember of the Village, from approving and providing compensation to Mr. Fuller under <br /> the Proposed Contract. <br /> Chznges to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics.
