La. R.S. 42:1117 provides that no public servant or other person shall give, pay, loan, transfer, or <br /> deliver or offer to give, pay, loan, transfer, or deliver, directly or indirectly, to any public servant <br /> or other person any thing of economic value which such public servant or other person would be <br /> prohibited from receiving by any provision of this Part. <br /> La. R.S. 42:1102(22)(a) defines "thing of economic value" to mean money or any other thing <br /> having economic value. <br /> ANALYSIS <br /> La. R.S. 42:1111A(1)(a) prohibits the Senior Center's Manager from receiving anything of <br /> economic value, other than the compensation and benefits from the Senior Center to which she is <br /> duly entitled, for the performance of the duties and responsibilities of their office or position. <br /> La. R.S. 42:1115 prohibits the Senior Center's Manager from accepting,directly or indirectly, any <br /> thing of economic value as a gift or gratuity from any person who: 1) has or is seeking to obtain <br /> contractual or other business or financial relationships with the public servant's agency; 2) <br /> conducts operations or activities which are regulated by the public employee's agency; or 3) has <br /> substantial economic interests which may be substantially affected by the performance or <br /> nonperformance of the public employee's official duty. <br /> La. R.S. 42:1117 prohibits the clients at the Senior Center from giving or delivering, directly or <br /> indirectly, any thing of economic value to the Senior Center's Manager or other person, including <br /> her baby, which she is prohibited from receiving by any provision of the Code. <br /> CONCLUSION <br /> The Board concluded,and instructed me to infonn you,that the Code prohibits the Senior Center's <br /> Manager froin accepting gifts given to her baby by clients at the Senior Center. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
