Larvadain <br /> Lake Charles Housing Authority �, ��D� T��� <br /> 400 West Hale Street - <br /> Lake Charles, Louisiana 70601 Pursuant to <br /> LSA-R.S.42:1141.4K <br /> Re: Docket No. 2025-375 <br /> Advisory Opinion <br /> Dear Mr. Larvadain: <br /> The Louisiana Board of Ethics, at its meeting on August 8, 2025, considered your request for an <br /> advisory opinion regarding whether the Code of Governmental Ethics ("Code") prohibits you, a <br /> Councilman for the City of Alexandria, from filing a lawsuit in your capacity as a private attorney <br /> against the Alexandria Housing Authority. <br /> FACTS PROVIDED <br /> You currently serve as the elected Councilman from District One in the City of Alexandria. You <br /> stated that you are a practicing personal injury attorney. You would like to know if the Code of <br /> Governmental Ethics prohibits you from filing a lawsuit against the Alexandria Housing Authority. <br /> LAW <br /> La. R.S. 42:1111E (2)(a)No elected official of a governmental entity shall receive or agree to <br /> receive any thing of economic value for assisting a person in a transaction or in an appearance in <br /> connection with a transaction with the governmental entity or its officials or agencies, unless he <br /> files a written statement with the board prior to or within ten days after initial assistance is <br /> rendered. <br /> La.R.S.42:1102(2)(a)(vi)defines"agency"to mean, for public servants of political subdivisions, <br /> it shall mean the agency in which the public servant serves, except that for members of any <br /> governing authority and for the elected or appointed chief executive of a governmental entity, it <br /> shall mean the governmental entity. <br /> La.
