The Code of Ethics prohibits the former Assistant Director for the Office of Facility Planning and Control of the Division of Administration from assisting BECI for compensation, for a period of two years from the termination of his employment, with any transaction involving the Division of Adminsitration in which he participated while employed with the Office of Facility Planning and Control.

La.R.S.42:1102(18)(a) defines"public employee" to mean anyone,whether compensated or not, <br /> who is: <br /> (i) An administrative officer or official of a governmental entity who is not filling an elective <br /> office. <br /> (ii) Appointed by any elected official when acting in an official capacity, and the appointment is <br /> to a post or position wherein the appointee is to serve the governmental entity or an agency thereof; <br /> either as a member of an agency, or as an employee thereof. <br /> (iii) Engaged in the performance of a governmental function. <br /> (iv) Under the supervision or authority of an elected official or another employee of the <br /> goverrunental entity. <br /> La. R.S. 42:1102(19) defines "public servant" as a public employee or an elected official. <br /> ANALYSIS <br /> In your capacity as FPC Assistant Director, you were a "public employee" pursuant to La. R.S. <br /> 42:1102(18) and a "public seivant" pursuant to La. R.S. 42:1102(19). Your governmental entity <br /> was the State of Louisiana pursuant to La. R.S. 42:1102(12), and FPC was your agency pursuant <br /> to La. R.S. 42:1102(2)(a). <br /> La. R.S. 42:1121 B(1) prohibits you, for two years following your retirement from public <br /> employment with FPC on January 6, 2025, from assisting another individual or legal entity; <br /> including BECI or its clients for compensation in a transaction, or in an appearance in connection <br /> with a transaction,in which you participated at any time during your public employment with FPC <br /> and involving the State of Louisiana. However, you are not prohibited from assisting BECI or its <br /> clients for compensation on any matter involving the State of Louisiana in which you did not <br /> previously participate during your einployment with FPC. <br /> La. R.S. 42:1121B(1) also prohibits you, for two years following your retirement from public <br /> employment with FPC on January 6, 2025, from rendering any service, which you previously <br /> rendered to FPC during your public employment, on a contractual basis to, for, or on behalf of <br /> your former agency,FPC,regardless of the parties to the contract. However,you are not prohibited <br /> from rendering new services that you have not previously rendered to FPC during your public <br /> employment, on a contractual basis to, for, or on behalf of FPC. <br /> Additionally, La. R.S. 42:1121C prohibits BECI, for two years following your retirement from - <br /> public einployinent with FPC on January 6, 2025, from assisting another person (individual or <br /> legal entity), such as a client, for compensation in a transaction, or in an appearance in connection <br /> with a transaction, in which you previously participated at any time during your public <br /> employment and involving FPC. However, BECI is not prohibited from assisting another person <br /> for compensation in connection with a transaction involving FPC in which you did not previously <br /> participate during your employment with FPC. <br /> Page 3 of 4 (BD 2025-458) <br />
