Additionally, the exception requires that the <br /> elected official shall recuse himself from acting in his official capacity on the transactions. Finally, <br /> the exception further sets out requirements depending on the amount of the transaction. See La. <br /> R.S. 42:1123(22) for specific requirements. <br /> La. R.S. 42:1102(11) defines "governing authority" to mean the vody which exercises the <br /> legislative functions of a political subdivision. <br /> La. R.S. 42:1102(13) detines "inlmediate family" to include the spouse of a sibling of a public <br /> servant. <br /> La. R.S. 42:1114(A) Each public servant and each member of his immediate family who derives <br /> any thing of economic value, directly,through any transaction involving the agency of such public <br /> servant or who derives any thing of economic value of which he may be reasonably expected to <br /> know through a person which (1) is regulated by the agency of such public servant, or (2) has bid <br /> on or entered into or is in any way financially interested in any contract, subcontract, or any <br /> transaction under the supervision or jurisdiction of the agency of such public servant shall file <br /> public disclosure statements with the Board by May 15 of each year. <br /> PROPOSED PLAN <br /> Pursuant to La. R.S.42:1123(22),the Town of Grand Isle has proposed that the Town will purchase <br /> items occasionally as needed. Councilwoman Harley Stelly shall recuse herself from participating <br /> in all matters involving the purchases. All transactions will be handled on behalf of the Town of <br /> Grand Isle by the agency head of the agency making tl�e purchase. The Town of Grand Isle will <br /> seek quotations for the services. Councilwoman Harley Stelly will file quarterly affidavits with the <br /> Board as rec�uired by La. R.S. 42:1123(22). <br /> ANALYSIS cRt CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the proposed purchasing plan <br /> regarding Sureway Supermarket meets the requirements of the Board and is hereby approved. <br /> The Board fui-ther concluded, and instructed me to inform you,that Shelly Maples shall file public <br /> disclosures with the Board annually by May 15t�' while the purchasing plan is in effect. Form 405 <br /> is available at ethics.la.gov/disclosures. A copy of this opinion will be forwarded to Ms. Maples. <br /> This advisory opinion is based solely on the facts as set forth herein.
