public service and involving the agency by which he was formerly employed or in which he <br /> formerly held office. <br /> ANALYSIS <br /> As Assistant Superintendent and Director of Federal Programs for Pointe Coupee Parish School <br /> Board, you are a public employee and public servant pursuant to La. R.S. 42:1102(18) and (19), <br /> respectively. Your agency for purposes of the Code is the Pointe Coupee Parish School Board. <br /> La. R.S. 42:1113A(1)(a) prohibits you and SES from entering into any contract, subcontract, or <br /> other transaction that is under the supervision or jurisdiction of Pointe Coupee Parish School <br /> Board. However, you and SES are not prohibited from entering into transactions with other school <br /> districts. Additionally, La.R.S.42:1111 A(1)(a)requires that you provide the services through SES <br /> outside your normal working hours at Pointe Coupee Parish School Board. <br /> Lastly, since you may be retiring within the next year or two,La. R.S. 42:1121,for a period of two <br /> years following your retirement from public employment with the Pointe Coupee Parish School <br /> Board, prohibits you and your company from assisting another person for compensation in a <br /> transaction, or in an appearance in connection with a transaction, in which you participated at any <br /> time during your public employment and involving the Pointe Coupee Parish School Board. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code does not prohibit you or <br /> your company, SES, while employed with the Pointe Coupee Parish School Board or following <br /> your retirement,from assisting other Louisiana School Districts or consulting with other Louisiana <br /> School Districts regarding their federal programs or assisting their federal programs with <br /> monitoring, budgeting, and application support. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
