Transactions with your agency <br /> Pursuant to La. R.S. 42:1113A(1)(a), neither you nor BrightPath shall enter into any contract, <br /> subcontract,or other transaction that is under the supervision or jurisdiction of Erath High School. <br /> However, La. R.S. 42:1123(30) provides an exception which permits you and/or BrightPath to <br /> donate the licensing of the software and use of the software to Erath High School provided there <br /> are no stipulations associated with the donation. <br /> Transactions with your father's agency. <br /> As Superintendent for the Lafayette Parish School District, Francis Touchet, is a "public <br /> employee" pursuant to La. R.S. 42:1102(18)(a), and a public servant pursuant to La. R.S. <br /> 42:1102(19.Francis Touchet's agency is the Lafayette Parish School District,including all schools <br /> within the District pursuant to La. R.S. 42:1102(2)(a)(vi). Francis Touchet, as your father, is a <br /> member of your immediate family as defined by La. R.S. 2:1102(13). <br /> La. R.S. 42:1113A(1)(a) prohibits you and BrightPath from entering into contracts, subcontracts, <br /> or transactions under the supervision or jurisdiction of your father's agency, the Lafayette Parish <br /> School District and any school within its District. However, the Code does not prohibit you or <br /> BrightPath from donating to your father's agency. Therefore, you and/or BrightPath would be <br /> allowed to donate the licensing of the software and use of the software to schools within the <br /> Lafayette Parish School District provided there are no stipulations associated with the donation. <br /> Transactions with other school districts. <br /> There are no prohibitions from you and/or BrightPath from entering into any contracts, <br /> subcontracts, or transactions under the supervision or jurisdiction of any other school or school <br /> district other than Erath High School and the schools within Lafayette Parish School District. <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that the Code prohibits you and BrightPath <br /> from entering into transactions with Erath High School and all the schools within Lafayette Parish <br /> School District. You and BrightPath are allowed to enter into transactions with other school <br /> districts and receive compensation for those transactions. Further, nothing in the Code prohibits <br /> you or BrightPath from donating the licensing of your software program and use of the software <br /> to any school. However, any donations made to Erath High School or schools within Lafayette <br /> Parish School District must not have any stipulations. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics. The Board issues no opinion as to past conduct or as to <br /> laws other than the Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure <br /> Act,the Lobbyist Disclosure Acts,and the conflict of interest provisions contained in the Louisiana <br /> Gaming Control Law. <br /> Page 3 of 4 (BD 2025-628) <br />
