ANALYSIS <br /> As Program Manager in FQS, you are a public employee pursuant to La. R.S. 42:1102(18)(a)(iii) <br /> and a public servant pursuant to La. R.S. 42:1102(19). Your agency is FQS pursuant to La. R.S. <br /> 42:1102(2)(a)(i). The grant application was submitted to LEPRB. FQS and LEPRB are separate <br /> divisions under the Animal Health and Food Safety Department within the Louisiana Department <br /> of Agriculture. <br /> La. R.S. 42:1113A(1)(a) prohibits you and a legal entity in which you have a controlling interest <br /> from entering into contract, subcontract, or other transaction under the supervision or jurisdiction <br /> of your agency, FQS. Since you have no ownership interest in Deep South and the grant will be <br /> awarded by the LEPRB and not your agency, neither you nor Deep South is prohibited from <br /> applying for or receiving grant funding from the LEPRB. <br /> Further,La. R.S. 42:1111E(1)(a)prohibits you from receiving compensation for assisting a person <br /> in a transaction with your agency. Even though you do not receive compensation from Deep South <br /> at this time, you are not prohibited from receiving compensation for assisting Deep South in <br /> securing grant funding from LEPRB since LEPRB is not your agency. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you,that the Code does not prohibit Deep South <br /> from applying for or receiving grant funds from the LEPRB. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics.
