Ethics Board Docket No. 2023-307 <br /> Page 4 of10 . <br /> 11. <br /> On March 9, 2023, Hesperus submitted sealed bids in the above-appraised-value amount <br /> of$216,323.04 for the 1132 Hesper Lot and in the above-appraised-value amount of$281,323_00 <br /> for the 1124 Hesper Lot. <br /> 12. <br /> An employee was reviewing Secretary of State documents that were submitted with the <br /> bids to ascertain the company's proper t'stle when the er�ployee saw Mr. Simno's name on the <br /> paperwork and notified Mr. Simno of this discovery. <br /> I3. <br /> If called to testify,Mr. Simno would state that the reason the Secretary of State doeuments <br /> were submitted was NIr. Simno's desire for full disclosure and transparency, that he didn't know <br /> this submittal was an issue, and, if he had known he would have i�runediately souaht to correct it <br /> prior to submittal and that he subsequently did immediately seek to correct it by informing the <br /> employee that he did not want Hesperus ta buy any property if it was improper to do so and <br /> requesCing widance. Mr. Simno would further staxe that other loeal governmental ethics baards <br /> have investigated this znatter and found no violation,that he believes BOE's opinion is erroneous <br /> as Hesperus did nat engage in a transaction with his District 5 agency, and that BOE rs now <br /> prescrihed from actina on this matter. <br /> 14. <br /> �n Aprii 12, 2023, the Couracil adopted Resolution 141739 rejecting all bids as non- <br />
