R.S. <br /> 42:ll02(2){a)(vi)was the District 5 Council Office for 3efferson Parish. <br /> The Jefferson Farish Council, including the District 5 Councilmember,was responsible for <br /> designating surplus property owned by Jefferson Parish as na Ionger needed for a public purpose; <br /> authorize such property be sold; direct the Parish Administration to solicit and accept bids to <br /> purchase su�h property; and, confect any sale of such surplus property. The Je�ferson Parish <br /> Couneil, on reeommendation of t�►e District 5 Councilmember, designated the property Iocated at <br /> 1132 and 1124 Hesper as suxplus and directed the Pazisla Administration to solicit and accept bids <br /> for the purchase of the property. <br /> Hesperus, LLC is a Limited liability company autharized to do and doing business in the <br /> State of Louisiana and is a legal entity. Mr. Stmno holds a SO%membership interest in Hesperus, <br /> LLC;therefore, he owns a conxroliing interest as de£�ined by La. R.S.42:I 102(8}. <br /> As an empioyee of Jeffersan Parish Council District S, Mr. Simna and any lega! entity in <br /> which he �ias a controlling interest was prohibited from submitting any bids that were under the <br /> supervisian ar jurisdiction of his agency. Therefore, Hesperus, LLC's submission of a brd to <br /> purehase the 1132 and 1124 Hesper Lots designated by the Parish Council, including Council <br /> District 5,violated.La. R.S. 42:I 113A_ <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"), <br /> and the EAB found a violation of the Etl�ics Code,the EAB cvuld impose a fine of up to $10,004 <br /> for each violation of the Ethics Code. In�his particular matte:r, it is the conclusion of the BOE <br /> that the interests of the public would be served by, arid tke parties have agreed to resolving this <br />
