R.S. 42:1102(19) defines "public servant" means a public employee or an elected official. <br /> ANALYSIS <br /> While you were employed at LHC in the capacity as Director of Multifamily Housing <br /> Development, you were a public employee pursuant to La. R.S. 1102(18)(a)(ii) and a public <br /> servant pursuant to La.R.S.42:1102(19).Your agency,for purposes of the Code,is the Multifamily <br /> Housing Development (MFHD) pursuant to La. R.S. 42:1102(2)(a)(vi) and you were an "agency <br /> head" pursuant to La. R.S. 42:1102(3). <br /> La. R.S. 42:1121A(1) <br /> La. R.S. 42:1121 A(1) prohibits you, for a period of two years following your resignation from <br /> LHC (until September 26, 2027), from assisting your private firm and/or any non-profit, for <br /> compensation,in any matter involving the MFHD, including the Low-Income Housing Tax Credit <br /> Program,the HOME Investment Partnerships Program,the National Housing Trust Fund,the Tax- <br /> Exempt Bond Program, and the Community Development Block Grant-Disaster Recovery <br /> initiatives. The prohibition includes providing technical assistance or guidance to applicants <br /> seeking funding from the aforementioned agency and/or programs. <br /> La. R.S. 42:1121C <br /> La. R.S. 42:1121C prohibits any legal entity (including non-profits) in which you are an officer, <br /> director, trustee, partner, or employee, for a period of two years following the termination of your <br /> public service, from assisting another person, for compensation, in a transaction, or in an <br /> appearance in connection with a transaction in which you participated at any time during your <br /> public service involving MFHD, including the programs under MFHD's jurisdiction. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you,that the Code prohibits you, and any legal <br /> entity you may establish, for a period of two years following your resignation as Director of the <br /> MFHD at LHC, from receiving compensation for assisting other persons with transactions <br /> involving your former agency, MFHD, including the Low-Income Housing Tax Credit Program, <br /> the HOME Investment Partnerships Program, the National Housing Trust Fund, the Tax-Exempt <br /> Bond Program, and the Community Development Block Grant-Disaster Recovery initiatives. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics. The Board issues no opinion as to past conduct or as to <br /> laws other than the Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure <br /> Act,the Lobbyist Disclosure Acts,and the conflict of interest provisions contained in thw Louisiana <br /> Gaming Control Law. <br /> Page 3 of 4 (BD 2025-707) <br />
