such person has or is seeking to have a contractual, business or financial relationship with the <br /> public servant's agency. <br /> La.R.S.42:1102(18)(a) defines"public employee" to mean anyone,whether compensated or not, <br /> who is: (i) An administrative officer or official of a governmental entity who is not filling an <br /> elective office. (ii) Appointed by any elected official when acting in an official capacity, and the <br /> appointment is to a post or position wherein the appointee is to serve the governmental entity or <br /> an agency thereof, either as a member of an agency, or as an employee thereof. (iii) Engaged in <br /> the performance of a governmental function. (iv) Under the supervision or authority of an elected <br /> official or another employee of the governmental entity. <br /> La. R.S. 42:1102(19) defines "public servant" means a public employee or an elected official. <br /> La. R.S. 42:1102(2)(a)(iv) defines "agency" to mean a department, office, division, agency, <br /> commission, board, committee, or other organizational unit of a governmental entity. <br /> La. R.S. 42:1102(a)(iv) For public servants in the legislative branch of state government, it shall <br /> mean the agency or house of the legislature by which a public employee is employed and the <br /> legislative branch in the case of legislators. <br /> ANALYSIS <br /> You are a public employee pursuant to La. R.S. 42:1102(18)(a) and a public servant pursuant to <br /> La. R.S. 42:1102(19). Your agency is LLFO pursuant to La. R.S. 42:1102(2)(a)(iv). <br /> Pursuant to La. R.S. 42:1111 C(2)(d),you are prohibited from receiving a thing of economic value, <br /> through compensation received, for services rendered to the local behavioral health agency while <br /> there is a contractual, business, and/or financial relationship with your public agency. However, <br /> there is no contractual,business, and/or financial relationship between your public agency and the <br /> health agency. Therefore, it is permissible for you to render services to the health agency. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code permits you to perform <br /> notarial and accounting services for a private company on a part-time basis, and outside your <br /> normal working hours, for compensation while you are an employee at the Louisiana Legislative <br /> Fiscal Office. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics.
