Box 3836 <br /> Baton Rouge, LA 70821 <br /> Re: Docket No. 2025-762 <br /> Advisory Opinion <br /> Dear Ms. Humbles: <br /> The Louisiana Board of Ethics, at its March 6, 2026 meeting, considered your advisory opinion <br /> and request to approve the disqualification plan under the Code of Governmental Ethics (the <br /> "Code") regarding the employment of Courtney Elizabeth Olivia, a Disability Determinations <br /> Manager, and her brother, John Byron Durkin, as an IT Tech Support Analyst 3 at the Louisiana <br /> Department of Health("LDH"), Disability Determination Services Program("DDS"). <br /> FACTS PROVIDED <br /> You are the Deputy Executive Counsel for LDH. You have submitted a disqualification plan for <br /> approval regarding Courtney Olivia, a Disability Determinations Manager, and her brother, John <br /> Durkin, IT Tech Support Analyst 3 in DDS. <br /> Ms. Olivia was promoted to her position on February 19, 2024. Mr. Durkin was promoted to his <br /> position on June 13, 2022. Ms. Olivia directly reports to Christopher Kirby, the Director of the <br /> Disability Determination Services Program. Lastly, Ms. Olivia is in the line of direct supervision <br /> over Mr. Durkin but there are two levels of management between Ms. Olivia and Mr. Durkin. <br /> The DDS Program was transferred to LDH from the Louisiana Department of Children and Family <br /> Services in October of 2025. Upon review of employment records, Ms. Humbles discovered this <br /> potential nepotism issue and requests the following disqualification plan for approval. <br /> LAW <br /> La.
