42:1112C provides that a Disqualification Plan may be submitted to the BOE for approval to avoid <br /> a potential violation. A Disqualification has been filed. <br /> PROPOSED DISQUALILFICATION PLAN <br /> Ms. Olivia has and will continue to be disqualified from any and all appointing authority duties <br /> regarding the employment of Mr. Durkin. These duties include but are not limited to pay, <br /> performance evaluation, promotion, decisions and/or approvals that may involve a potential <br /> substantial economic interest for Mr. Durkin. All such duties are the responsibility of his <br /> Appointing Authority, Christopher Kirby. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, the Code does not prohibit the continued <br /> employment of John Durkin while his Courtney Olivia serves as the Disability Determinations <br /> Manager. Further, the proposed disqualification plan is approved, as it is sufficient to prevent <br /> violations under La. R.S. 42:111213(l) of the Code and meets the Board's requirements pursuant <br /> to Louisiana Administrative Code Title 52, Chapter 14, Section 1402. <br /> Changes to the facts as presented may result in a different application of the provisions of the <br /> Louisiana Code of Governmental Ethics.
