Ethics Board Docket No. 2023-390 <br /> Page 5 of 9 <br /> Upon a determination that any public employee or other person has violated any <br /> provision of any law within the jurisdiction of the Board of Ethics except violations <br /> of the Campaign Finance Disclosure Act which shall be governed by Chapter 11 of <br /> Title 18 of the Louisiana Revised Statutes of 1950, the Ethics Adjudicatory Board <br /> may remove, suspend, or order a reduction in pay, or demotion of the public <br /> employee or other person, or impose a fine of not more than ten thousand dollars, <br /> or both. <br /> La. R.S. 42:1155(A)provides the following with respect to civil penalties for illegal gain: <br /> If an investigation conducted pursuant to this Part reveals that any public servant <br /> or other person has violated any law within the jurisdiction of the Board of Ethics <br /> to his economic advantage, and after an adjudicatory hearing on the matter, the <br /> Ethics Adjudicatory Board may order the payment of penalties. Recovery may <br /> include, in addition to an amount equal to such economic advantage, penalties not <br /> to exceed one half of the amount of the economic advantage. <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE that Denarold Anderson violated La. R.S. 42:1113B by virtue <br /> of entering into or having a substantial economic interest in transactions under the supervision or <br /> jurisdiction of the St. John the Baptist Parish Housing Authority while his mother, Madeline <br /> Jasmine, served as Commissioner with the St. John the Baptist Parish Housing Authority, for <br /> which he received $466.00 in rental income from the Housing Choice Voucher Program in 2022 <br /> and an additional $9,339.00 in 2023. <br /> As a Commissioner for the St. John the Baptist Parish Housing Authority, Madeline <br /> Jasmine was a public servant pursuant to La. R.S. 42:1102(19). Madeline Jasmine's agency was <br /> the St. John the Baptist Parish Housing Authority pursuant to La. R.S. 42:1102(2)(a)(vi). As <br /> Madeline Jasmine's biological child, Denarold Anderson, is a member of her immediate family <br /> pursuant to La. R.S. 42:1102(13). Accordingly, Denarold Anderson was prohibited by La. R.S. <br /> 42:1113B from entering into a transaction under the supervision or jurisdiction of Madeline <br />
