La. R.S. 42: 1102(8) defines " elected official" to mean any person holding an office in a governmental entity which is filled by the vote of the appropriate electorate. La. R.S. 42: 1102(18) defines " public servant" to mean a public employee or an elected official. ANALYSIS If elected to office, you would be an elected official pursuant to La. R.S. 42:1102(8) and a public servant pursuant to La. R.S. 42: 1102(18). Your agency would be the Legislature pursuant to La. R.S. 42: 1102(2)(a)(iv). In accordance with La R.S. 42: 1113C, you and your companies, IFS and ABS, would be prohibited from bidding on, entering into, or have a substantial economic interest in any contract, subcontract, or other transaction involving the Legislature. Further, La. R.S. 42:1113D would prohibit you, IFS and ABS from entering into any contract with the state government. Because you and/or your companies are entering into contracts, subcontracts, or other transactions with political subdivisions,and not the Legislature or the State,you may continue to represent Louisiana political subdivisions for their insurance and risk management needs if you are elected to the House of Representatives. CONCLUSION The Board concluded, and instructed me to inform you, that the Code permits you to continue to represent political subdivisions through your private companies, IFS and ABS, should you get elected to the House of Representatives—District 60. Changes to the facts as presented may result in a different application of the provisions of the Louisiana Code of Governmental Ethics. The Board issues no opinion as to past conduct or as to laws other than the Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure Act,the Lobbyist Disclosure Acts,and the conflict of interest provisions contained in the Louisiana Gaming Control Law.
