The Code of Governmental Ethics does not prohibit New Orleans Redevelopment Authority from entering into a contract with the joint venture team of HRI Communities and Travelers Aid Society of Greater New Orleans, and Brenda Breaux is not prohibited from receiving the benefit of her spouse's employment compensation from TASGNO while it maintains a contract with NORA, provided Brenda Breaux and her husband meet all six of the conditions listed under La. 42:1111C(5)(a).

As 1�,xecutive Director, you are t11e offici�] signatory for NORA; however, if NORA is permitted <br /> to enter into a contract with NRI and TASCiNO, you would disc�ualify yourself from participating <br /> in any transaction involving TASC'1N0, and NORA's f3oard of Commissioners would, by <br /> i•esolution, appc�int an alternate signatory, such as the C�hief Financial Officer or the Board <br /> ("hairperson, to execute the contract on behalf of NORA. <br /> LAw <br /> La. R.S. 42:1111C(2)(d) provides that no public servant...shall receive any thing of economic <br /> value tbr or in consideration of services rendered, or to be rendered, to or for any person during <br /> his public service unless such services are neither performed for nor compensated by any person <br /> who has or is seeking to obtain contractual or other business or financial relationships with t11e <br /> public servant's agency. <br /> La. R.S. 42:1111C(S)(a) provides that, notwithstandin�the provisions of Subparagraph (2)(d) of <br /> this Subsection, the spouse of a public servant may continue employment with a person who has <br /> or is seeking a contractual or other business �r financial relationship with the public servant's <br /> agency provided all of the following conditions are n�et: <br /> (i)Tl1e spouse is a salaried or wage-earning employee and has been continuously employed <br /> by the person for at least one year prior to the date the compensated employment would <br /> have otherwise initially been prohibited. <br /> (ii) ThE compe»sation of the spouse is substantially u�naffected by a contractual or othcr <br /> business or tin�lcial relationsl�ip with the public servant's agency. <br /> (iii) Neither the public servant nor the spouse is an owner, ofticer, director, trustee, or <br /> partner in the legal entity which 11as <>r is seeking to have the relationship with the public <br /> serva.nt's agency. <br /> (iv) The public servai�t recuses or disgualifies himself froin participating in any transaction <br /> involving the spouse's einployer in accordance with IZ.S. 42:1112 and related rules and <br /> regulations. <br /> (v) Either prior to or within ten business days of the date the compensated e��nployment <br /> � would otherwise be prollibited,the spouse and the public servant jointly file wiYh the Board <br /> oP F,thics a written notice containing a brief description of the nature of the contractual, <br /> business,or iinancial relationship with tl�e public servant's agency, the date the s�ouse was <br /> employed by the person, and any other intormation reQuired by the board. <br /> (vi) The spouse complies with the disclosure requirements in R.S. 42:11 l4. <br /> La. R.S. 42:1112C states every public employee, excluding an appointed member of any board or <br /> commission, shall disc�ualify himself fi•om participating in a transaction iilvolvi�lg th�; <br /> govermne���tal entity when a violation of this Nart would result. "I'he procedures for such <br /> disqualification s11a11 be established by regulations issued pursuant to R.S. 42:1134(A)(1). <br /> La. R.S. 42:1114A provides that each public servant and each inember of his iinmediate family <br /> who derives anything of econonlic value, directly, through any transaction �involving the ag�ncy <br /> of suc;h public servant or who derives anything of economic value of which he may be reasonably <br /> expected to know through a person which (]) is r•egulated by the agency of such public servant, or <br /> (2) ]Zas bid on or entered into or is in any way financially interested in any contract, subc<�ntract, <br /> Pagc 2 of 4 (I3D 2026-082) <br />
