La. R.S. 42:1102(12) defines"governnlei7tal entity" to mean tl�e state or ai�y political subdivision which employs the public e-mployee or employed the former public employee or to which the electEd oilicial is elected, as the case may be. La.R.S.42:1102(l5)defines"participate" to mean to take part in or to l�ave or share responsibility i'or action of a governmental entity or a proceeding, personally, as a public servant of the governmental entity, through approval, disapproval, decision, recommendation, the rendering of advice, investigation, or the failure to act or perform a duty. La. R.S. 42:1102(16) defines "person" to mean an individual or legal entity other than a governmental entity, or an a.gency thereof. La. R.S. 42:1102(17)(a)de{ines"public employee" to mean anyone,whetlier compensated or not, who is: (i) An adnlinistrative officer or official of a governmental entity who is not filling an elective oftice. (ii) Appointed by any elected ofticial when actin� in an off cial capacity, and t]Ze appointment is to a post or position whereiu the appointee is to serve the governmental entity or an agency thereoP, either as a member of an agency, or as an employee thereof. (iii) t?ngaged in the per�Formance of a governanental function. (iv) Under the supervision or authority of an elected official or another employee of t11e governmental entity. ANALYSIS Prior to October l, 2025, your agency was the Geological Oil and Gas Division within DENR's Office oF Conservation pursuant to La. R.S. 42:1102(2)(a)(i). As the Petroleum Scientist Administrator, you were the agency head of the Geological Oil and Gas Division pursu�nt to La. R.S. 42:1102(3). Generally, L,a. R.S. 42:ll21A(1) prohibits you, in your capacity as a tormer age.ncy head, from assisting another person for compensation in a transaction or in an appearance in connection with a transaction involving your former agency, the Geological Oil and Gas Division, or from rendering any service on a contractual basis to or for your former agency, the Geological Oil and Gas Division,ior a period of two years following the termination of your publ ic service as the agency head of the Geolo�ical Oil and Gas Division. However, since there is no longer a Geological Oi] and Gas Divisio��, this post-employment restriction cannot be enforced a�;a.inst you. As o��October 1, 2025, your agency is the Permitting Division within C&E's Office of Perm�itting and Complialzce pursuant to �La. R.S. 42:1102(2)(a)(i). As a Petroleum Scientist Manager l, you � are a public en�ployee pursuant to La. R.S. 42:1102(17)(a)(iv), but you are not an agency head. La. R.S. 42:ll21B(1) will prohibit you, in your capacity as a former public emptoyec, from assisting another person for compensation in a transaction or in an appearance in comlection with a transaction, in which you participated at any time during your public employment ai�d involving the State of Louisiana,tl�e gove�nmental entity by which you were formerly employed,for a period of two years following the date of termination of your public employment.
