OPINION <br /> It is essential to the proper operation of democratic government that governmental <br /> decisions and policy be made in the proper channel of the governmental structure. La. R.S. <br /> 42:1102B. Accordingly, it is the opinion of the BOE that Dr. Larry Hollier, in his capacity as <br /> Chancellor for LSUHSC-NO, violated La. R.S. 42:1117 by virtue of his offering and paying of <br /> supplemental compensation payments to Keith Schroth from November 1, 2020, to November 1, <br /> 2021, which Keith Schroth was not duly entitled to receive without proper authorization, for the <br /> performance of his duties as Vice Chancellor for Administration and Finance of LSUHSC-NO. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Ethics Code, the Ethics Adjudicatory Board <br /> could impose a fine of up to $10,000 for each violation of the Ethics Code, pursuant to Section <br /> 1153B of the Ethics Code. In light of the fact that Mr. Schroth performed the duties of his position <br /> both before and after his promotion, in this particular situation, it is the conclusion of the Board <br /> that the interest of the public would be served by the publication of this Consent Opinion with the <br /> imposition of a$1,500.00 civil penalty against Dr. Keith Hollier. <br /> VL ORDER <br /> For the foregoing reasons: <br /> IT IS ORDERED that Dr. Larry Hollier, in his capacity as Chancellor for LSUHSC-NO, <br /> violated La.
