You also seek the Board's opinion as to whether you may work on that <br /> contract since it is completely unrelated to the Mitigation Office. <br /> The Board concluded, and instructed me to advise you,that the Code of Governmental Ethics will <br /> not prohibit your participation on the New Orleans mitigation grants so long as the grants are not <br /> those in which you participate in while you were a public employee. Section 1121B(1) states that <br /> no former public employee shall, for a period of two years following the termination of his public <br /> employment assist another person, for compensation, in a transaction, or in an appearance in <br /> connection with a transaction in which such former public employee participated at any time during <br /> his public employment and involving the governmental entity by which he is formerly employed. <br /> According to your opinion request you will not be working on any of the grants or programs that you <br /> dealt with or participated in while you were at the Mitigation Office. Thus,no violation of the Code <br /> of Ethics appears to be presented from your initial question. Accordingly,no violation would occur <br /> if WMS were awarded the other contract with the City that has to do with emergency response since <br /> that contract is completely unrelated to the Mitigation Office. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts <br /> presented may result in a different application of the provisions of the Code of Ethics. The <br /> Board issues no opinion as to past conduct or laws other than Code of Governmental Ethics.
