Opinion that the Code of Governmental Ethics (Code) does not require members of the Executive Committee of the Bossier Parish Republican Party, who are not public servants or public employees as defined by the Code, to participate in the training requirement contained in the Code. The qualifying fees paid by candidates running for public office are used to fund the Committee.

R.S. 42:1170(3) provides an annual training requirement for "public servants" and provides <br /> as follows: <br /> Commencing on January 1, 2012 each public servant who was not required to <br /> complete education and training pursuant to Paragraph(1) or(2)of this Subsection <br /> shall receive a minimum of one hour of education and training on the Code of <br /> Governmental Ethics during each year of his public employment or term of office, <br /> as the case may be. (Emphasis added) <br /> The Board concluded and instructed me to inform you that members of the Executive Committee <br /> of the Bossier Republican Party are not public servants as defined by the Code of Ethics. Since <br /> members of the Committee do not hold office in a governmental entity then they are not elected <br /> officials. Further,the members of the Committee are not public employees since they are not within <br /> the definition provided in Section 1102(18) of the Code. Therefore, members of Bossier Parish <br /> Republican Executive Committee are not subject to the training requirement set forth in Section <br /> 1170 of the Code of Ethics. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
