Box 311 ' <br /> Marion, La 71260 <br /> Re: Ethics Board Docket No.2013-1464 <br /> Dear Mr. Farr: <br /> The Louisiana Board of Ethics, at its December 20,2013 meeting,considered your request <br /> for an advisory opinion regarding whether Section 1121 of the Code of Governmental Ethics(Code) <br /> would prohibit you from contracting with Louisiana Delta Community College(LDCC)to provide <br /> food services at their West Campus. You retired in October 2013 from LDCC where you served as <br /> the a Regional Coordinator for the Police Academy.Your job duties were to coordinate the training <br /> calender for the Police Academy.You would like to know if you are prohibited from bidding on and <br /> entering into a contract with LDCC to provide food services on the West Campus. <br /> The Board concluded and instructed me to inform you that Section 1121 the Code would not <br /> prohibit you from bidding on or entering into a contract with the LDCC to provide food services at <br /> the West Campus. Section 1121B prohibits a public employee, for two years following the <br /> termination of his public service, from assisting another person for compensation in a transaction <br /> involving his former agency and in which the public employee participated or from rendering <br /> any service which such former public employee had rendered to the agency during the term of his <br /> public employment on a contractual basis. Since you will not be assisting a person for <br /> compensation in which you participated during your public employment,nor will you be <br /> rendering any service on a contractual basis to your former agency that you provided during your <br /> employment, Section 1121 of the Code will not prevent you from bidding on or entering into a <br /> food service contract with LDCC. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or laws other than Code of Governmental Ethics.
