Box 311 '
Marion, La 71260
Re: Ethics Board Docket No.2013-1464
Dear Mr. Farr:
The Louisiana Board of Ethics, at its December 20,2013 meeting, considered your request
for an advisory opinion regarding whether Section 1121 of the Code of Governmental Ethics(Code)
would prohibit you from contracting with Louisiana Delta Community College(LDCC)to provide
food services at their West Campus. You retired in October 2013 from LDCC where you served as
the a Regional Coordinator for the Police Academy.Your job duties were to coordinate the training
calender for the Police Academy. You would like to know if you are prohibited from bidding on and
entering into a contract with LDCC to provide food services on the West Campus.
The Board concluded and instructed me to inform you that Section 1121 the Code would not
prohibit you from bidding on or entering into a contract with the LDCC to provide food services at
the West Campus. Section 1121B prohibits a public employee, for two years following the
termination of his public service, from assisting another person for compensation in a transaction
involving his former agency and in which the public employee participated or from rendering
any service which such former public employee had rendered to the agency during the term of his
public employment on a contractual basis. Since you will not be assisting a person for
compensation in which you participated during your public employment, nor will you be
rendering any service on a contractual basis to your former agency that you provided during your
employment, Section 1121 of the Code will not prevent you from bidding on or entering into a
food service contract with LDCC.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts
presented may result in a different application of the provisions of the Code of Ethics. The Board
issues no opinion as to past conduct or laws other than Code of Governmental Ethics. If you have
any questions, please contact me at (225)219-5600 or(800) 842-6630.
Sincerely,
LOUISIANA BOARD OF ETHICS
ICc7° 1111 ---
uzanne Quinlan Mooney
For the Board
AN EQUAL OPPORTUNITY EMPLOYER
