You stated that the Police Jury has supervision and jurisdiction over the <br /> concessions vendor. According to a copy of the vendor contract provided,the Recreation Director <br /> would sign the contract on behalf of the Police Jury. Further,you stated that the Recreation Director <br /> provides a permanent structure for concessions, involved with the menu and pricing offered; and <br /> provides the Recreation Department with detailed accounting sales. <br /> The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics would <br /> prohibit Salvadore Genusa, Sr. from entering into a concessions contract with the Pointe Coupee <br /> Parish Police Jury while his son, Salvadore Genusa,Jr. serves as the Parks&Recreation Director. <br /> La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate <br /> family,or a legal entity in which he has a controlling interest shall bid on or enter into any contract, <br /> subcontract or other transaction that is under the supervision or jurisdiction of the agency of such <br /> public servant. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
