• <br /> COMMISSION ON ETHICS FOR PUBLIC EMPLOYEES <br /> DATED: December 15, 1987 ADVISORY OPINION NO. 87 -229 <br /> RE: Opinion concerning whether volunteer advisers to a Governor-Elect <br /> are "public employees" subject to the Code of Governmental Ethics <br /> The Commission on Ethics for Public Employees ( "the Commission ") has <br /> received a request for an advisory opinion from Governor-Elect Buddy Roemer. <br /> The thrust of the request is to determine whether p^sons such as <br /> certified public accountants, attorneys, engineers, bankers, architects, <br /> investment brokers, private health care providers and telecommunications <br /> • experts become "public employees," as defined by the Code of Governmental <br /> Ethics, by reason of their serving on a volunteer basis it f an advisory <br /> capacity to Governor -Elect Buddy Roemer. These volunteers would assist the <br /> Governor -Elect by collecting information and providing advice relative to the <br /> State's fiscal situation. <br /> It is represented in the request for the advisory opinion that: <br /> "1. These volunteers will be donating their time. That <br /> is, none of them will be compensated for their <br /> services by [the Governor - Elect], the Transition <br /> Office or the State of Louisiana. <br /> 2. All of their services will be rendered directly and <br /> solely to [the Governor - Elect]. <br /> 3. None of these volunteers will be supervising any <br /> elected official or public employee. Nor will these <br /> volunteers be supervised by any elected official or <br /> • public employee. To the contrary, they will si ply <br /> be developing information by examining public rec rds <br /> and conducting discretionary interviews with pu lic <br /> servants. No public servant will be compelle to <br /> talk with any of these volunteers. <br />
