Romero
232 West Main Street
New Iberia, Louisiana 70560
Re: Ethics Board Docket No. 2014-850
Dear Mr. Romero:
The Louisiana Board of Ethics, at its August 15, 2014 Board meeting considered your request for
an advisory opinion regarding whether you may receive compensation from existing insurance
policies with customers of the Port of Iberia(Port)if you became an employee of the Port. You state
that you are a licensed property and casualty insurance producer for Laris Insurance Agency(Laris).
If hired by the Port you state you will maintain your employment with Laris. You currently have an
existing policy with Iberia Aggregates which has a lease with the Port. You state that the term of this
policy is one year and renews on January 25, 2015. You receive compensation for the policy and
renewals.
The Board concluded, with Board Members Bruno and Lemke dissening, and instructed me to
inform you, that the Code of Governmental Ethics (Code) would prohibit you from receiving
compensation from Laris for Iberia Aggregates'policy in the event you are hired by the Port.Section
1111 C(2)(d) prohibits a public servant from receiving anything of economic value for or in
consideration of services rendered or to be rendered to a person who has or is seeking to have a
contract with your agency. Iberia Aggregates has a contract with your potential agency, the Port of
Iberia. Compensation received from the existing insurance policy or renewal would be considered
receiving something of economic value for services rendered to Iberia Aggregates. This
compensation would be prohibited.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented
may result in a different application of the provisions of the Code of Ethics. The Board issues no
opinion as to past conduct or laws other than Code of Governmental Ethics. If you have any
questions, please contact me at(225) 219-5600 or(800) 842-6630.
Sincerely,
LOUISIANA BOARD OF ETHICS
aeze46.14:61„____
Brett Robinson
For the Board
AN EQUAL OPPORTUNITY EMPLOYER
