Romero <br /> 232 West Main Street <br /> New Iberia, Louisiana 70560 <br /> Re: Ethics Board Docket No. 2014-850 <br /> Dear Mr. Romero: <br /> The Louisiana Board of Ethics, at its August 15, 2014 Board meeting considered your request for <br /> an advisory opinion regarding whether you may receive compensation from existing insurance <br /> policies with customers of the Port of Iberia(Port)if you became an employee of the Port. You state <br /> that you are a licensed property and casualty insurance producer for Laris Insurance Agency(Laris). <br /> If hired by the Port you state you will maintain your employment with Laris. You currently have an <br /> existing policy with Iberia Aggregates which has a lease with the Port.You state that the term of this <br /> policy is one year and renews on January 25, 2015. You receive compensation for the policy and <br /> renewals. <br /> The Board concluded, with Board Members Bruno and Lemke dissening, and instructed me to <br /> inform you, that the Code of Governmental Ethics (Code) would prohibit you from receiving <br /> compensation from Laris for Iberia Aggregates'policy in the event you are hired by the Port.Section <br /> 1111 C(2)(d) prohibits a public servant from receiving anything of economic value for or in <br /> consideration of services rendered or to be rendered to a person who has or is seeking to have a <br /> contract with your agency. Iberia Aggregates has a contract with your potential agency, the Port of <br /> Iberia. Compensation received from the existing insurance policy or renewal would be considered <br /> receiving something of economic value for services rendered to Iberia Aggregates. This <br /> compensation would be prohibited. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
