Boudreaux, Jr. <br /> 610 Belle Terre Blvd. <br /> LaPlace, La. 70068 <br /> Re: Board Docket No. 2014-1055 <br /> Dear Mr. Boudreaux: <br /> The Louisiana Board of Ethics, at its October 17, 2014 meeting, considered <br /> your request for an advisory opinion regarding whether the Code of Governmental <br /> Ethics(Code)would prohibit your firm,Environmental Engineering Inc.,from hiring <br /> Danny Scott, the brother of Lutcher Mayor Rowdy Scott, to work on the Lutcher <br /> water system as a consulting engineer. You stated that your firm, Environmental <br /> Engineering Inc, has a contract with the Town of Lutcher to determine what water <br /> valves are existing and what new water valves are needed. Presently, when a water <br /> main breaks,the town personnel have to shut down the whole system to fix the main. <br /> The shut down causes a public health hazzard. The town currently has no record of <br /> where the existing valves are located. You have determined that the only person who <br /> has knowledge of the existing water system is Danny Scott. Danny Scott worked for <br /> the Town Water Department for over 20 years and retired over two years ago. <br /> La.R.S.42:1113A prohibits a public servant,a member of his immediate family <br /> or a legal entity in which either owns a controlling interest, from bidding on or <br /> entering into a contract,subcontract or transaction that is under the supervision <br /> or jurisdiction of the public servant's agency. <br /> The Board concluded,and instructed me to inform you,that Section 1113A of <br /> the Code would prohibit Danny Scott from being hired by or entering into a contract <br /> with Environmental Engineering, Inc. to provide services to the Town of Lutcher. <br /> Section 1113A of the Code prohibits a public servant or members of their immediate <br /> family from bidding on or entering into any contract, subcontract or other transaction <br /> under the supervision of the public servants agency,-.Danny Scott is the immediate <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
